OVERVIEW

The terms “we,” “us,” and “our” refer to Hope Haven Foundation. The term the “Site” refers to https://hopehavenfoundation.org. The terms “user,” “you,” and “your” refer to site visitors, donors, volunteers, program participants, and any other users of the Site.

Hope Haven Foundation is a nonprofit organization headquartered in Alpharetta, Georgia. We provide charitable, educational, community-based programs, fundraising initiatives, volunteer opportunities, and related nonprofit services (the “Service”).

Use of https://hopehavenfoundation.org, including all materials presented herein and all online services provided by Hope Haven Foundation, is subject to the following Terms and Conditions. These Terms and Conditions apply to all site visitors, donors, volunteers, and all other users of the Site. By using the Site or Service, you agree to these Terms and Conditions, without modification, and acknowledge reading them.

USE OF THE SITE AND SERVICE

To access or use the Site, you must be 18 years of age or older and have the requisite power and authority to enter into these Terms and Conditions. Children under the age of 18 are prohibited from using the Site without parental or guardian consent.

Information provided on the Site and in the Service related to charitable programs, fundraising activities, volunteer opportunities, and nonprofit subject matter is subject to change. Hope Haven Foundation makes no representation or warranty that the information provided, regardless of its source (the “Content”), is accurate, complete, reliable, current, or error-free. Hope Haven Foundation disclaims all liability for any inaccuracy, error, or incompleteness in the Content.

ACCOUNT CREATION

In order to use certain features of the Service, including donations, event registrations, or volunteer sign-ups, you may be required to provide information about yourself including your name, email address, username and password, and other personal information. You agree that any registration information you give to Hope Haven Foundation will always be accurate, correct, and up to date.

You must not impersonate someone else or provide account information or an email address other than your own. Your account must not be used for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction.

LAWFUL PURPOSES

You may use the Site and Service for lawful purposes only. You agree to be financially responsible for all donations or purchases made by you or someone acting on your behalf through the Site.

You agree to use the Site and engage with the Service for legitimate nonprofit and charitable purposes only. You shall not post or transmit through the Site any material which violates or infringes the rights of others, is threatening, abusive, defamatory, invasive of privacy, vulgar, obscene, or otherwise objectionable, or which encourages conduct that would constitute a criminal offense or violate any law.

REFUSAL OF SERVICE

The Services are offered subject to our acceptance of your request or donation. We reserve the right to refuse service to any person or entity without the obligation to assign reason for doing so.

No donation, registration, or request is deemed accepted until payment has been processed, if applicable. We may at any time change or discontinue any aspect or feature of the Site or Service, subject to fulfilling our prior obligations.

ORDER CONFIRMATION

We will email you to confirm the placement of your donation, registration, or purchase and provide details concerning participation or delivery. In the event there is an error in this email confirmation, it is your responsibility to inform us as soon as possible.

CANCELLATIONS, REFUNDS & RETURNS

All donations made through the Site are final and non-refundable unless otherwise required by law.

Event registration refunds, if applicable, will be governed by the specific terms listed on the event registration page. Hope Haven Foundation reserves the right to determine refund eligibility on a case-by-case basis.

PRODUCT DESCRIPTION

We endeavor to describe and display our programs, services, and events as accurately as possible. While we strive for clarity, the Site may not be entirely accurate, current, or error-free. We reserve the right to correct errors in descriptions or pricing and to cancel any registration or order with incorrect information.

MATERIAL YOU SUBMIT TO THE SITE

You shall not upload, post, or otherwise make available on the Site any artwork, photos, or other materials protected by copyright, trademark, or other proprietary rights without the express written permission of the owner.

You are solely responsible for determining that materials you submit are not protected or that you have proper authorization. You shall be liable for any damage resulting from infringement or unlawful submission.

INTELLECTUAL PROPERTY RIGHTS TO YOUR MATERIALS

We claim no intellectual property rights over material you supply to Hope Haven Foundation. You retain copyright and any other rights you may hold in content you submit.

By posting material on the Site, you grant us a worldwide, nonexclusive, irrevocable license to use the material for promotional, fundraising, business development, and marketing purposes consistent with our nonprofit mission.

OUR INTELLECTUAL PROPERTY

The Site and Service contain intellectual property owned by Hope Haven Foundation, including trademarks, logos, branding elements, written materials, and other proprietary content.

You may not modify, publish, transmit, distribute, reproduce, create derivative works from, or exploit any Site or Service content without prior written consent. We reserve the right to remove access to the Service if you violate this policy.

CHANGED TERMS

We may at any time amend these Terms and Conditions. Amendments are effective immediately upon posting the updated Terms on the Site. Continued use of the Site or Service constitutes acceptance of the revised Terms.

LIMITATION OF LIABILITY

YOU AGREE THAT UNDER NO CIRCUMSTANCES SHALL HOPE HAVEN FOUNDATION BE LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF YOUR USE OF THE SITE OR SERVICE.

IN NO EVENT SHALL HOPE HAVEN FOUNDATION’S CUMULATIVE LIABILITY TO YOU EXCEED THE TOTAL AMOUNT OF DONATIONS OR PAYMENTS YOU HAVE MADE TO HOPE HAVEN FOUNDATION THROUGH THE SITE. IF NO PAYMENT HAS BEEN MADE, LIABILITY SHALL NOT EXCEED $250.

THIRD PARTY RESOURCES

The Site and Service may contain links to third party websites and resources. You acknowledge that we are not responsible for the availability, accuracy, content, or policies of third party websites. Links do not imply endorsement or affiliation.

INDEMNIFICATION

You shall indemnify and hold harmless Hope Haven Foundation from and against any losses, damages, liabilities, costs, and expenses, including reasonable attorney’s fees, arising out of your breach of these Terms and Conditions or misuse of the Site or Service.

EFFECT OF HEADINGS

The subject headings of this Agreement are included for convenience only and shall not affect interpretation.

ENTIRE AGREEMENT; WAIVER

This Agreement constitutes the entire agreement between you and Hope Haven Foundation pertaining to the Site and Service and supersedes all prior agreements. No waiver of any provision shall be deemed a waiver of any other provision unless executed in writing.

GOVERNING LAW; VENUE; MEDIATION

This Agreement shall be construed in accordance with and governed by the laws of the State of Georgia as applied to contracts executed and performed within Georgia.

The exclusive venue for any court proceeding arising out of this Agreement shall be Fulton County, Georgia.

The parties agree to attempt to resolve any dispute arising out of this Agreement through good faith mediation prior to pursuing litigation or other legal remedies.

RECOVERY OF LITIGATION EXPENSES

If any legal action or proceeding is brought for enforcement of this Agreement, the prevailing party shall be entitled to recover reasonable attorney’s fees and costs.

SEVERABILITY

If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

ASSIGNMENT

These Terms and Conditions bind and inure to the benefit of the parties’ successors and assigns. These Terms are not assignable by you without prior written consent from Hope Haven Foundation.
